Absolutely horrible business- I do not recommend. I prepaid for 5 treatments and after the 3rd, I asked if I could change to something different as it was more painful than they described it would be and the results were EXTREMELY unimpressive. They agreed to exchange the treatments (for which I was grateful) but was told that the 3rd Avenue location was “moving” (they provided NO notice whatsoever) and could not see me until the end of the month. I reached out to schedule and was told that I could be seen in Brooklyn, which is absolutely unreasonable, so I requested a refund, and was told that the contract states “no refunds”. I’ve submitted a complaint to the NYS Attorney General Consumer Protection Unit as well as the Better Business Bureau. According to General Business Law §349, businesses are closing the contracted location and refusing to provide a reasonable substitute constitutes a failure to perform, and I am entitled to a refund of the undelivered portion. A “no refunds” clause would apply if I had chosen not to use the service, not when the business is unable to provide the service as promised.
Since the location I contracted with closed, the BYOU is arguably not fulfilling the terms of the contract, at minimum, this is a failure of consideration for the remaining treatments. I urge anyone being deceived and stolen from by BYOU to report this immediately to the NYS Attorney General and NYS department of Consumer and Worker Protection.
